
City of Fort Smith & Port Authority of Fort Smith – Disaster Recovery Success
Background:
The City of Fort Smith and the Port Authority of Fort Smith were significantly impacted by the 2019 Arkansas River Flood (DR-4441) and the COVID-19 Pandemic. These events caused widespread damage to public infrastructure and disrupted essential services. AG Witt was engaged to support both entities in navigating the complex FEMA Public Assistance process.
Port Authority of Fort Smith:
Initially, the Port Authority’s Request for Public Assistance (RPA) was denied by FEMA, with legal counsel determining the Port did not qualify as an eligible applicant. After AG Witt conducted a thorough review of the Port’s documentation and submitted a detailed analysis, FEMA was asked to revisit the determination. As a result, FEMA reversed its decision, recognizing the Port Authority as eligible.
Outcome:
AG Witt successfully helped the Port Authority develop and submit 15 FEMA projects, resulting in a total obligation of $4.5 million—funding that would have otherwise been inaccessible.
City of Fort Smith:
AG Witt provided comprehensive recovery support to the City of Fort Smith, including eligibility guidance, documentation, and project formulation.
